Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") define the conditions of use for the online store "BLACK PEACH" (hereinafter referred to as "the Store") operated by BLACK PEACH Co., Ltd. (hereinafter referred to as "the Company"). By using the Store, customers are deemed to have agreed to these Terms.

Article 1 (Applicability)

These Terms apply to all relationships between the customer and the Company regarding the use of the Store.

Article 2 (Order and Formation of Contract)

  1. A sales contract for a product is formed when the Company confirms the order (e.g., by sending an order confirmation email) in response to the customer's order.
  2. The Company may choose not to accept an order or may cancel a contract in the event of out-of-stock items, incorrect pricing, or other unavoidable circumstances.

Article 3 (Price and Payment)

  1. The selling price of products shall be the amount displayed in the Store (including consumption tax).
  2. Payment shall be made using the payment methods displayed on the checkout screen.

Article 4 (Product Shipment)

The shipment and delivery time of products shall be as stipulated in the Notation based on the Act on Specified Commercial Transactions. Delays may occur due to delivery conditions, weather, etc.

Article 5 (Returns and Exchanges)

Returns and exchanges shall be subject to the provisions of the Return and Exchange Policy.

Article 6 (Prohibited Acts)

Customers must not engage in the following acts when using the Store:

  • Acts that infringe upon the intellectual property rights or other rights of the Company or a third party
  • Purchases for the purpose of resale or other fraudulent purposes
  • Acts of registering false information
  • Acts that interfere with the operation of the Store, unauthorized access, etc.

Article 7 (Intellectual Property Rights)

Copyrights, trademark rights, and other intellectual property rights related to product images, logos, designs, texts, etc., displayed in the Store belong to the Company or the rightful owners. Unauthorized reproduction, reprinting, or secondary use is prohibited.

Article 8 (Disclaimer)

  1. While the Company makes every effort to ensure the completeness and accuracy of the content and product information in the Store, it does not guarantee their completeness or accuracy.
  2. The Company shall not be liable for damages caused by natural disasters, communication line failures, payment system malfunctions, or other reasons not attributable to the Company.
  3. The scope of damages for which the Company is liable due to reasons attributable to the Company shall be limited to the price of the product concerned (excluding cases of willful misconduct or gross negligence on the part of the Company).

Article 9 (Changes to the Terms)

The Company may change these Terms without prior notice to customers if deemed necessary. The revised Terms shall become effective from the time they are posted in the Store.

Article 10 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. In the event of a dispute concerning the Store, the court having jurisdiction over the Company's location shall be the exclusive agreement jurisdiction court of the first instance.
